Tariffs are still a great way to clearly establish the relationship between service providers and their customers. A tariff provides both parties with many protections that might be tricky to negotiate in the form of a contract. A tariff protects the carrier from certain liabilities and lawsuits. But tariffs can also be a drain on resources and a drag on product and pricing changes.

In my 13 years of experience as a senior associate consultant with TMI, I have prepared and processed many telecom tariff filings for some of the biggest telecommunications carriers. Even in this deregulated, detariffed telecommunications industry, customer notice is still a hot topic with the FCC and State Commissions. Most State Commissions require telecommunications carriers to notify affected customers of any price increases or additions of new rates via a bill message, bill insert, or by direct mail. Some states require carriers to file a copy of the customer notice with the tariff revision.

A new law in Delaware (effective June 26, 2013) reduces the Public Service Commission’s jurisdiction over telecommunications service providers that did not elect deregulation in 2008. Among other things, the new law prohibits the PSC from requiring non-electing providers to file tariffs for services other than switched access.
