California Sends Letter to ISPs Regarding Data Caps and Data Overage Charges
The California PUC has sent a letter to the top five largest wireless and top ten largest ISPs in the state asking them to consider temporarily suspending data caps and data overage charges if they have not already done so.

Court Denies Motion to Stay Access Arbitrage Order
US Court of Appeals for the District of Columbia issued an order denying motion for stay of the FCC's Access Arbitrage order. That order adopted rules aimed at eliminating the financial incentives to engage in access stimulation. Under the new rules, a CLEC will be considered an access stimulator if it has an interstate terminating-to-originating traffic ratio of at least 6:1 in an end office in a calendar month. If a CLEC is engaged in access stimulation it may not bill an IXC for terminating switched access tandem switching or terminating switched access transport for any traffic between its terminating end office (or equivalent) and the associated access tandem switch.

As I indicated in my earlier blog (Draft Access Stimulation Order -- Big Net with Big Consequences? dated 9/16/19), there were number of problems with the FCC’s proposed solution to the arbitrage issue.

The September 5 draft Order on eliminating access arbitrage is the FCC’s latest effort to address what is also known as “access stimulation”, and they made little effort to hide their true feelings on the issue. While their intent when it comes to certain business plans seems quite clear, some new provisions in the proposed order could lead to unintended outcomes and impact service providers who are far removed from any activities typically regarded as access stimulation.

NTIA Report on Spectrum Repurposing
NTIA released the first annual report showing continuing efforts to repurpose parts of the nation’s radiofrequency spectrum to meet the future communications needs of commercial and federal users. The report shows that the United States already leads the world in spectrum available for 5G technology and is working to more-than-double the radio spectrum available for the next generation of wireless network technology.
