On Monday, the Justice Department dropped its 2018 lawsuit challenging California’s state net neutrality rules. The litigation was initiated when California adopted its own net neutrality rules following the FCC’s 2017 repeal of federal regulations prohibiting internet service providers from speed throttling, site and app blocking, and paid fast lanes.

The Federal Trade Commission, with the concurrence of the Antitrust Division of the U.S. Department of Justice, has issued a Notice of Proposed Rulemaking and an Advance Notice of Proposed Rulemaking regarding proposed changes to the rules and interpretations implementing the Hart-Scott-Rodino Act (HSR).

In a press release, the Department of Justice (DOJ) announced that the United States and the United Kingdom entered into the world’s first ever Clarifying Lawful Overseas Use of Data Act (CLOUD Act) Agreement that will allow American and British law enforcement agencies, with appropriate authorization, to demand electronic data regarding serious crime, including terrorism, child sexual abuse, and cybercrime, directly from tech companies based in the other country, without legal barriers.

The Department of Justice announced today that the Department’s Antitrust Division is reviewing whether and how market-leading online platforms have achieved market power and are engaging in practices that have reduced competition, stifled innovation, or otherwise harmed consumers.

FTC-2FTC CAN-SPAM Rule

The Federal Trade Commission (FTC) announced today that it has completed its first review of the CAN-SPAM Rule, which establishes requirements for commercial e-mail messages and gives recipients the right to opt out of receiving them.  The FTC voted to keep the Rule with no changes.  The Rule requires that a commercial e-mail contain accurate header and subject lines, identify itself as an advertisement, include a valid physical address, and offer recipients a way to opt out of future messages.
