Nevada Stacks the Odds Against Regulatory Compliance

Last year, the Nevada PUC embarked on a "zero tolerance" policy for telecom carriers and other regulated utilities who filed late or incomplete annual reports, annual assessments, TDD surcharges, and CMRS (wireless) licensing fees. Based on a Staff Petition filed last August, the Commission issued an order to "show cause" why regulated companies who filed any of those reports/fees even a single day late or with just a small error or omission should not be fined or have their certificates revoked. Many companies filed comments in response to the show cause petition to plead their cases and demonstrate that they had come into compliance well prior to issuance of the petition. The comments had little to no effect and the Commission issued fines for all but a handful of the more than 100 companies on the show cause list.

CA Wireless Carriers Ask For Reconsideration of Bond Requirement

In June 2013, the California PUC issued a Decision revising the registration process for wireless carriers (and the certification process for telephone corporations).   See our 6/6/13 blog posting " California PUC - Performance Bond from CPCN and WIR."

On July 3, 2013, a group of wireless carriers filed a request for rehearing of the decision to impose a $25,000 (continuing) performance bond requirement on all wireless telecommunications carriers.

Maine PUC Changes Rules for ETC and Lifeline/Link-up

The Maine PUC adopted amendments to the standards for the designation and annual certification of Eligible Telecommunications Carriers (ETCs). In a separate Order, it also adopted amendments to the eligibility criteria for the Lifeline and Link-Up programs. When the adopted rules become effective, the PUC will no longer designate Lifeline-only ETCs. Going forward, such carriers will apply to the FCC for ETC designation. The rule changes will become effective after publication by the Secretary of State.

Change to E-911 Assessments for CT and MD

Recently Connecticut and Maryland adopted changes to E-911 fees. Both changes effect the manner in which prepaid wireless providers  remit their E-911 fees.  The changes are set to take effect on  July 1, 2013.

The California PUC has ordered all CPCN holders and all WIR carriers to obtain a performance bond of $25,000. Carriers of Last Resort (COLR) are exempt from the requirement to obtain a performance bond.

New Hampshire PUC Proposes New Telecom Rules

The New Hampshire PUC has proposed new telecommunications rules.  A new   category of telephone utility - Excepted Local Exchange Carrier (ELEC) - will be established.  A new term - Voice Service Provider (VSP) - will refer to all telephone public utilities.  Proposed rules address registration and reporting; tariffs and rate schedules; and customer relations.  VSPs will have to provide essential telecommunications service to their customers and ILECs will be required to provide basic service.  If you need assistance evaluating the impact of these rules, TMI can help you.
