FCC Clarification of RTT Rule

The FCC has clarified certain implementation issues surrounding the transition from text telephony (TTY) technology to real-time text (RTT).  Specifically, it clarified that when a CMRS provider delivers RTT 911 calls to a legacy PSAP served by a selective router, the CMRS provider is responsible for performing the necessary conversion from IP to circuit-switched format before it delivers the call to the selective router.  For RTT 911 calls to a legacy PSAP served by an Emergency Services Internet Protocol Network (ESInet), the conversion to circuit-switched format is the responsibility of the ESInet provider. (An ESInet is a managed IP based emergency services network that supports voice and data call delivery to PSAP, both NG 911-capable PSAPs and legacy PSAPs.)

In a Public Notice, the FCC’s Wireline Competition Bureau is seeking comment on the voluntary remand by the D.C. Circuit Court of the FCC’s Tariff Investigation Order that found certain provisions in tariffed pricing plans for business data services offered by AT&T, CenturyLink, Frontier, and Verizon were unlawful.    Parties are asked to address issues that will permit the FCC to consider the extent to which the reasoning in the Order is compatible with a 2006 court decision involving an AT&T challenge to a BellSouth Term Service Plan or to otherwise reconsider its determination that the tariff provisions in question were unlawful.  Comments are due December 4, 2017; replies are due December 19, 2017.

FCC Requests Update on CAF High-Cost Performance Measures

The FCC’s Wireline Competition Bureau, Wireless Telecommunications Bureau, and Office of Engineering Technology are seeking input to update the record regarding performance measures for Connect America high-cost universal service support recipients, including price cap carriers, rate-of-return carriers, rural broadband experiment support recipients, and Connect America Phase II auction winners.  In particular, the Notice seeks comment on:

  1. whether the FCC should require the same testing method options and parameters for all high-cost recipients of support to serve fixed locations and, if not, what different options or parameters it should consider;
  2. the FCC’s previous proposal to require all ETCs subject to fixed broadband performance obligations to use testing parameters for speed like those adopted for latency for price cap carriers; and
  3. a proposal by the U.S. Telecommunications Association for a general broadband speed and latency measurement reporting and compliance framework.  Comments are due December 6, 2017.
