Today:  FCC Sends General Information and Document Request to T-Mobile-Sprint, FCC Commissioner Carr Statement on D.C. Circuit's Wireless Infrastructure Decision 

FCC Sends General Information and Document Request to T-Mobile-Sprint

The Federal Communications Commission (FCC) submitted a request for General Information and Document Request for Sprint [WT Docket No. 18-197] asking for Sprint (the Company) to provide, among other things:

  • A current organization chart and personnel directory for the Company as a whole and for each of the Company’s facilities or divisions involved in any activity relating to any Relevant Product or Relevant Service in any Relevant Area; and provide full and complete copies of the merger agreement and any side or letter agreements or other related agreements (and all amendments and attachments thereto) that T-Mobile and Sprint have entered into that relate to the Proposed Transaction, including the Proxy, Lock-up and Right of First Refusal Agreement (Proxy Agreement) between Deutsche Telekom and SoftBank, and any side or letter agreements or other agreements (and all amendments and attachments thereto) related to the Proxy Agreement, which the Applicants state will be executed prior to closing.
  • In addition, the 29-page request asked that the Company provide a complete list of MVNOs that have provided or are providing mobile wireless service using Sprint’s network and explain in detail how the Proposed Transaction would affect current MVNO agreements. Provide all documents discussing the possible effects of the Proposed Transaction on wholesale charges or discussing New T-Mobile’s offering of wholesale arrangements.

FCC Commissioner Carr Statement on D.C. Circuit’s Wireless Infrastructure Decision

August 15, 2018, the D.C. Circuit denied a motion to stay the Commissions March 2018 infrastructure order that modernized the agency’s wireless siting rules.  The FCC’s March order cut nearly 1.6 billion in regulatory red tape that threatened to slow the deployment of small cells and other next-generation wireless infrastructure necessary for 5G.

FCC Commissioner Brendan Carr issued the following statement, “Today’s court decision is good news for U.S. leadership on 5G.  The FCC’s commonsense reforms to our wireless siting rules help ensure we’re 5G Ready, and they’re already accelerating the buildout of next-gen networks.  I look forward to continuing our efforts to bring more broadband to more Americans.”
