Today:  FCC Small Cell Order Appeals Consolidated, FCC Mobility Fund Phase II Challenge Process Portal Update, FTC Sixth Session of Hearings on the Intersection of Big Data, Privacy, and Competition 

 

FCC Small Cell Order Appeals Consolidated

Multiple appeals of the last of the FCC’s Small Wireless Deployment Declaratory Ruling See the Regulatory Mix dated 10/31/18 were consolidated by the U.S. Judicial Panel on Multidistrict Litigation and will be heard in the Tenth Circuit (Denver).  The consolidation request was made by the FCC.  Appeals were filed in the First, Second, Ninth, and Tenth Circuits by various state and local entities.  The state entities generally sought review of the Order on the grounds it was arbitrary, capricious, and an abuse of discretion.  The industry petitioners challenged the FCC’s failure to adopt a deemed granted remedy.

 

FCC Mobility Fund Phase II Challenge Process Portal Update

The FCC’s Rural Broadband Auctions Task Force (Task Force), in conjunction with the Wireline Competition Bureau and the Wireless Telecommunications Bureau (the Bureaus) provided the sixth update about the Mobility Fund Phase II (MF-II) challenge process.  As of October 31, 2018, a total of 106 entities have access to the Universal Service Administrator Company (USAC) MF-II Challenge Process Portal to participate in the MF-II challenge process.  Of these entities, 38 are mobile service providers required to file Form 477 data; 19 are state government entities; 27 are local government entities; 16 are Tribal government entities; and six are other entities that have filed petitions requesting, and have each been granted, a waiver to participate.  A total of over 8 million speed tests have been submitted during the course of challenge process.
