California Defines Scope of Hearings on T-Mobile/Sprint Merger
The California PUC has scheduled evidentiary hearings on December 5 and 6, 2019 regarding the proposed Sprint /T-Mobile transaction that is before the PUC. The PUC is now seeking to determine what impact new agreements between Sprint, T-Mobile, and Dish Networks (DISH) will have on the proposed merger.

FCC Suspends T-Band Application Processing
The FCC issued a Public Notice suspending the processing of applications for T-Band (470-512 MHz band) licenses, including renewals, in accordance with the current T-Band mandate to hold an auction in 2021. Licensees that have filed, and will in the future file, timely and complete applications for renewal of license2 may continue to operate using their licensed facilities past the license expiration date while the suspension is in effect.

US Congress Privacy Legislation
U.S. Senate Committee on Commerce, Science, and Transportation Ranking Member Maria Cantwell (D-WA) and fellow senior members Senators Brian Schatz (D-HI), Amy Klobuchar (D-MN), and Ed Markey (D-MA) unveiled comprehensive federal online privacy legislation to establish privacy rights, outlaw harmful and deceptive practices, and improve data security safeguards for the record number of American consumers who now shop or conduct business online. The Consumer Online Privacy Rights Act (COPRA) gives Americans control over their personal data; prohibits companies from using consumers’ data to harm or deceive them; establishes strict standards for the collection, use, sharing, and protection of consumer data; protects civil rights; and penalizes companies that fail to meet data protection standards. The legislation also codifies the rights of individuals to pursue claims against entities that violate their data privacy rights and includes new safeguards to protect children and young people’s online privacy.

Court Denies Motion to Stay Access Arbitrage Order
US Court of Appeals for the District of Columbia issued an order denying motion for stay of the FCC's Access Arbitrage order. That order adopted rules aimed at eliminating the financial incentives to engage in access stimulation. Under the new rules, a CLEC will be considered an access stimulator if it has an interstate terminating-to-originating traffic ratio of at least 6:1 in an end office in a calendar month. If a CLEC is engaged in access stimulation it may not bill an IXC for terminating switched access tandem switching or terminating switched access transport for any traffic between its terminating end office (or equivalent) and the associated access tandem switch.

FCC Chairman Ajit Pai has announced the tentative agenda for the FCC’s December 12, 2019, Open Meeting. It includes the following items:
- VoIP Symmetry – An Order on Remand and Declaratory Ruling that would promote continued investment in IP-based networks by clarifying that a local exchange carrier partnering with a VoIP provider may assess end office switched access charges only if the carrier or its VoIP partner provides a physical connection to the last-mile facilities used to serve the end user.

FCC’s Starks on Network Security
FCC Commissioner Geoffrey Starks released a Report on the results of an FCC workshop held in June 2019 regarding the security threats that stem from the presence of certain Chinese communications equipment in US networks. The workshop contained three panels: Find It, Fix It, and Fund it. According to Starks, a “major takeaway from the workshop is that our networks must only contain equipment from trusted sources. When evaluating the security of a piece of communications networking equipment we should not ask “do I trust this piece of equipment” but instead, “do I trust the manufacturer?”

GAO Report Calls on FCC to Combat Fraud in the High-Cost Program
Energy and Commerce Committee Chairman Frank Pallone, Jr. (D-NJ) released a Government Accountability Office (GAO) report recommending that the FCC take additional action to prevent fraud and implement an anti-fraud strategy for the Universal Service Fund’s (USF) high-cost program, which provides $4.5 billion annually to support broadband service in high-cost areas.
